Policies
1. Services
1.1 Acceptable methods of registration for services include snail mail, email, and on site.
1.2 For all services, meetings cancelled with less than 48 hours notice will be billed at the rate of $50. If a makeup session is scheduled for the same calendar week, the fee will be waived. Meetings at which clients fail to appear will be billed at the rate of $85.
1.3 For all services, meeting time missed due to late arrival counts as billable time.
1.4 For all services, the invoice and/or automatic payment agreement provided by WriteByNight and signed by the client (full signature or initial, handwritten or electronic) functions as a binding agreement for services rendered and payment due.
1.5 Coaching services carry 1 hour minimum prep. time.
1.6 Coaching services must be delivered at least once per month.
1.7 For ghostwriting services, by signing the Author/Writer Agreement, the client is accepting and agreeing to the Author/Writer Agreement itself as well as WriteByNight’s Policies as set forth on this page (http://www.writebynight.net/policies).
1.8 For seminars and workshops, missed meetings are the sole responsibility of the client. Monetary compensation will not be provided.
1.9 Seminar and workshop structure and inclusions are subject to change at any time over the course of the offering.
1.10 Clients who are under 18 years of age require written permission from a parent or legal guardian to receive services.
2. Payment
2.1 Acceptable methods of payment include credit card, cash, or check made payable to WriteByNight.
2.2 For all services, payment is due 30 days after invoicing occurs. Late payment will incur a fee of $50 for every 30 days the payment is overdue.
2.3 The client’s previous balance must be paid before additional services are delivered.
2.4 For automatic payment, submit billing changes at least 5 days prior to the 15th of the month.
2.5 Payment for seminars and workshops is due in full prior to the offering. Any individual who has not pre-paid is asked to pay upon arrival or forfeit seat.
2.6 WriteByNight does not offer refunds. Credit is determined on a case-by-case basis and is at the discretion of WriteByNight.
3. Discounts
3.1 Only one discount may be applied to any one service at any given time.
3.2 When more than one discount applies, the client receives the offer carrying the greater reward.
3.3 The discount must be applied at the time of quoting. Retroactive discounts will not be honored.
3.4 Coaching discounts are applied to the total price of one 4-week billing cycle. Discounts for all other services are applied to the total price of the service. Seminar and workshop discounts are applied to the total price of the offering.
4. WBN Membership
4.1 Unpaid membership dues will result in the cessation of benefits.
4.2 Work featured in WriteByNight’s e-newsletter and/or blog may be edited for space and content as necessary. WriteByNight reserves the right to reject work that is deemed inappropriate or offensive. There is no guarantee that work submitted will be featured.
4.3 Members may be billed for unreturned books and/or materials borrowed from WriteByNight’s library, according to the book or material’s estimated value. Failure to pay may result in further penalty, such as revocation of library access and/or cessation of member benefits.
5. Etiquette
5.1 WriteByNight staff and clients agree to maintain professional conduct at all times while engaged in services, events, seminars and workshops.
5.2 WriteByNight reserves the right to deny service to or cease services with any individual who poses a threat to its staff, clients or property.
5.3 The party responsible for damage done to private property at WriteByNight headquarters located at 1305 E. 6th Street, Suite 4, Austin TX 78702 will carry the financial burden.
5.4 WriteByNight will not be held responsible for personal injury incurred on the premises.
6. Intellectual Property
6.1 The client maintains 100% rights to and ownership of any and all work submitted to WriteByNight and its staff. WriteByNight maintains 0% of the rights to and ownership of the work, unless expressly agreed upon in writing by client and WriteByNight.
6.2 All services delivered by WriteByNight to the client are confidential and private. All project details and correspondence between the client and WriteByNight and its staff is confidential. As such, WriteByNight and its staff is prohibited from divulging client-related information to any party without the client’s explicit consent delivered in writing.
